§ 1 Scope

1) The following General Terms and Conditions (hereinafter referred to as "GTC") ofChristopher glovetrading via Flora Edulis (hereinafter referred to as “seller”) apply to all orders (contracts) that you as a consumer (hereinafter referred to as “customer”) conclude with the seller via our online shop on our website. Our online shop is aimed exclusively at consumers. The inclusion of the customer's own conditions is contradicted, unless a special agreement has been made.

2) These terms and conditions apply accordingly to the purchase of vouchers if and insofar as nothing to the contrary is expressly regulated.

3) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

4) Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

5) Plants are living beings, therefore all illustrations, shape, color and size information of the plants in our online shop, on the website and in other marketing tools are only to be regarded as examples and approximate. In principle, deviations are possible.

§ 2 Conclusion of contract

1) The presentation of the products offered in the online shop does not constitute a legally binding offer, but a non-binding online catalogue.

2) You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you place a binding order for the goods contained in the shopping cart.

The receipt of your order will be confirmed by e-mail immediately after the order has been sent.

3) When the contract is concluded with us depends on the payment method you have chosen:

Payment in advance

We accept your order by sending a declaration of acceptance in a separate email within two days, in which we will give you our bank details.

4) We store the text of the contract concluded between the seller and the customer on internal systems. You can view the terms and conditions at any time in our online shop. We will send you the order data, our terms and conditions and theRight of withdrawalin text form by email. You can view the text of the contract in our customer login after completing the order, provided you have opened a customer account with us. However, you can also save or print out the order data immediately after the conclusion of the contract.

5) The language available for the conclusion of the contract is German.

6) It is your responsibility to provide a correct email address to process the order and to contact you.

§ 3 Prices and terms of payment

2) The following payment methods are generally available in our shop:

If you select the payment method in advance, we will give you our bank details in a separate email and deliver the goods after receipt of payment.

§ 4 Dispatch and delivery conditions

1) We only deliver our offered goods by mail.

2) Delivery will be made to the delivery address you have specified.

3) If the seller incurs any costs due to the specification of an incorrect delivery address, an incorrect recipient or any other circumstances, these are to be borne by the customer; exceptions are errors for which the customer is not responsible. Excluded from this are contracts for which the customer has already lodged an effective objection.

§ 5 Redemption of gift vouchers

1) Gift vouchers (also called "vouchers") that were purchased in our online shop can also only be used in this online shop (www.floraedulis.de) to be redeemed.

2) The voucher and any remaining credit can be redeemed up to the end of the third year after the year in which the voucher was purchased.

3) The voucher can only be redeemed before the order process is completed. Subsequent offsetting is not possible.

4) Only one voucher can be redeemed per order. It is not possible to redeem multiple vouchers.

5) The voucher can only be redeemed for the purchase of goods and not for the purchase of further vouchers.

6) If the value of a voucher is not sufficient to pay for the respective order, the difference is shown, which can be paid with one of the payment methods offered.

7) The balance of a voucher is neither paid out in cash nor does it earn interest.

8) The voucher is transferrable. The seller can make payments to the voucher holder who redeems the respective voucher with discharging effect. This does not apply if the seller has knowledge or grossly negligent ignorance of the non-authorization, the legal incapacity or the lack of authorization to represent the respective owner.

§ 6 Right of Withdrawal

1) In principle, every customer is entitled to a right of withdrawal, provided he/she is a consumer.

§ 7 Retention of title

1) The goods remain our property until full payment.

§ 8 Warranty and Liability for Defects

1) If goods are delivered with obvious transport damage, please report such defects to the person delivering the goods as soon as possible and contact us immediately. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the freight carrier or the transport insurance.

2) Unless otherwise expressly agreed below, the statutory right to liability for defects shall apply with regard to the warranty.

4) A guarantee for the varietal authenticity of our plants is only given after a prior written request by the customer via e-mail. Otherwise, the statutory warranty rights apply.

Section 10 Governing Law

1) The law of the Federal Republic of Germany applies to the exclusion of the laws on the international purchase of movable goods. 

The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the state in which the customer has his/her habitual residence as a consumer, remain unaffected.
